Terms & Conditions

Welcome to Trivasa. We are a small, founder-run home décor brand based in India. These Terms & Conditions explain the rules of using our website, placing an order, and being part of the Trivasa community. We have tried to write them in plain English rather than in dense legal language, because we'd rather you actually read them.

By visiting www.trivasa.in, creating an account, or placing an order, you agree to be bound by these terms. If anything here is unclear, please write to us at [trivasa.thf@gmail.com] before you place an order.

1. Acceptance of these terms

By accessing or using www.trivasa.co.in, or by placing an order through the Site, Instagram, or WhatsApp, you confirm that you have read, understood and agreed to be bound by these Terms & Conditions, our Privacy Policy, and our Replacements & Store Credit Policy. If you do not agree with any part of these terms, please do not use the Site or place an order with us.

Trivasa is a brand operated by Trivasa, a partnership registered in India, with its principal place of business at:

3. Who can use our Site

To place an order with Trivasa, you must:

Be at least 18 years of age, and

Be legally capable of entering into a binding contract under Indian law.

If you are under 18, you may use the Site only with the involvement and consent of a parent or legal guardian. By placing an order, you confirm you meet these conditions.

4. Our products

Every product listed on Trivasa has been chosen, photographed and described by us with care. However, please keep the following in mind:

Handcrafted variations: Many of our pieces are made by hand in small numbers. Two pieces of the same product will rarely be identical; small differences in colour, finish, texture, weight or dimensions are part of how the piece was made and not considered defects.

Photography and screens: We try to photograph each piece as accurately as possible, but the colour you see on your screen may differ slightly from the actual product depending on your device, screen settings and lighting.

Stock and availability: Listing a product on the Site does not guarantee availability. If a product is out of stock after you place an order, we will let you know within 24 hours and offer you a refund or an alternative.

We reserve the right to modify, discontinue or remove any product from the Site at any time, without notice.

6. Pricing and payment

All prices on the Site are in Indian Rupees (INR) and are inclusive of applicable taxes. Shipping charges are payable at Rs. 149 on order below Rs. 1499. For all orders above Rs. 1499, shipping is on us.

We reserve the right to change product prices at any time without prior notice. The price applicable to your order will be the price displayed at the time you place the order.

Pricing errors: Despite our best efforts, a product on the Site may occasionally be mispriced due to a typographical or system error. If we discover that a product you have ordered was incorrectly priced, we reserve the right to cancel the order, refund any payment made, and inform you of the correct price. You will not be obligated to purchase the product at the corrected price.

Payment: Currently, we accept payments only through UPI.

7. Order acceptance

When you place an order with us through Whatsapp or Instagram, you are making an offer to purchase the products chosen by you. An order is only considered accepted by us once we send you a dispatch confirmation email or SMS not when you complete payment.

We reserve the right to refuse or cancel any order at our discretion before dispatch, including (but not limited to) the following situations:

• The product is out of stock or no longer available.
• The product was incorrectly priced or described.
• We are unable to verify your billing or shipping information.
• We have reasonable grounds to suspect fraud, misuse, or breach of these terms.
• The delivery address is not serviceable by our courier partners.

If we cancel an order after payment has been made, the full amount will be refunded to your original payment method within 7–10 working days.

8. Shipping and delivery

We ship across India through reputed third-party courier partners. Standard delivery typically takes 7 to 10 working days from the date of dispatch. Detailed shipping information, including expected timelines and express delivery options, is available in our FAQ page.

Delivery timelines mentioned anywhere on the Site or communicated to you by our team are estimates, not guarantees. Trivasa is not liable for delays caused by:

• Courier or third-party logistics partners.
• Inaccurate or incomplete delivery addresses provided by the customer.
• Unavailability of the customer at the delivery location.
• Weather, transport disruptions, public holidays, or any other circumstances outside our reasonable control.

The risk of loss and ownership of the product passes to you upon delivery to the address you have provided.

9. Returns, replacements and refunds

Trivasa does not offer general returns. We do offer replacements or credit note only in the specific case of damage during transit, subject to the conditions and timelines set out in our Replacements & Credit Policy. By placing an order with us, you confirm that you have read and understood that policy.

Shipping charges paid at the time of placing the order are non-refundable in any circumstance, including order cancellation, refused delivery, or damage. Return shipping charges, where applicable, are borne by the customer as detailed in our Replacements & Store Credit Policy.

10. Intellectual property

All content on the Site; including but not limited to the Trivasa name, logo, wordmark, tagline ("The Heritage Finds"), product photography, illustrations, copy, packaging design, and graphic elements; is the intellectual property of Trivasa or our licensors and is protected by Indian and international copyright and trademark laws.

You may not reproduce, distribute, modify, publish, transmit, sell, or otherwise exploit any part of our content without our prior written permission. This includes, in particular, using our product photography for resale or commercial use elsewhere.

If you would like to feature Trivasa content on your blog, publication, or platform, we would love to hear from you; please write to [trivasa.thf@gmail.com] and we will be happy to oblige.

11. Content you share with us

When you tag @trivasa_theheritagefinds on Instagram, post a review on our Site, send us a photograph of your home with our products, or share any other content with Trivasa publicly or directly, you grant us a non-exclusive, royalty-free, worldwide, irrevocable licence to use, reproduce, modify, adapt, publish, and display that content for our marketing and promotional purposes; including reposting on our social media, website, and email communications.

We will always credit you where possible. If you would like a piece of your content removed from our channels, write to us at [trivasa.thf@gmail.com] and we will take it down promptly.

By sharing content with us, you confirm that:

• The content is yours, or you have permission to share it.
• It does not infringe anyone else's intellectual property or privacy.
• It does not contain unlawful, abusive, defamatory, or otherwise objectionable material.

12. Things you agree not to do

When using the Site, you agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable Indian law.
• Place fraudulent orders, use stolen payment instruments, or attempt to deceive Trivasa or other users.
• Copy, scrape, mirror, or systematically extract data from the Site without our written permission.
• Attempt to gain unauthorised access to the Site, our servers, our customer accounts, or any connected systems.
• Upload or transmit viruses, malware, or any other harmful code through the Site.
• Post or transmit content that is defamatory, abusive, threatening, obscene, or otherwise objectionable.
• Use the Site to harass, impersonate, or harm any other person or entity.
• Use any automated means (bots, scrapers, crawlers) to access the Site, except for legitimate search engine indexing.

We reserve the right to investigate and take appropriate legal action against anyone who violates these terms, including suspending or terminating their account and reporting them to the relevant authorities.

13. Limitation of liability

To the maximum extent permitted by Indian law:

Trivasa, its founders, employees and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of the Site or our products. This includes, without limitation, loss of profits, loss of data, loss of goodwill, or any business losses.

Our total aggregate liability to you for any claim arising under or related to a particular order shall not exceed the total amount you paid to Trivasa for that order.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or for personal injury caused by gross negligence.

14. Indemnity

You agree to indemnify and hold harmless Trivasa, its founders, employees, agents, suppliers and partners from any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to:

• Your breach of these Terms & Conditions or any of our policies.
• Your misuse of the Site or our products.
• Your infringement of any third-party rights, including intellectual property and privacy rights.
• Any content you upload, post, or share through or in connection with the Site.

15. Events outside our control

Trivasa shall not be held liable for any failure or delay in performing our obligations under these terms where the failure or delay is caused by events outside our reasonable control, including but not limited to:

Natural disasters, fire, flood, earthquake, severe weather.

Pandemics, epidemics, or public health emergencies.

War, riots, terrorism, civil disturbance, or government actions including lockdowns.

Strikes, lockouts, or labour disputes affecting our team, our partners, or our courier services.

Failures of internet, telecommunications, payment gateways, or third-party services we depend on.

In such events, we will make reasonable efforts to inform affected customers and resolve outstanding orders as soon as conditions allow.

16. Governing law and jurisdiction

These Terms & Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of India.

Any dispute that cannot be resolved amicably between you and Trivasa shall be subject to the exclusive jurisdiction of the courts at Jamshedpur, Jharkhand, India.

17. Changes to these terms

Trivasa reserves the right to modify, update, or replace any part of these Terms & Conditions at any time. Your continued use of the Site after changes have been published constitutes your acceptance of the updated terms. If you do not agree with any change, your only remedy is to stop using the Site.
